Welcome to http://www.chxamaka.com! These Terms of Service (“Terms”) govern your use of this website and your purchase of artwork from Chiamaka Anyiam (“Artist,” “we,” “our,” or “us”). By using this site or purchasing artwork, you agree to these Terms.
1. Intellectual Property & Copyright
- All artworks, images, text, and other materials on this site are the intellectual property of Chiamaka Anyiam and are protected by copyright law.
- Purchasing a physical artwork gives you ownership of that particular object, not the copyright or reproduction rights.
- You may not copy, reproduce, distribute, modify, or publicly display any artwork or images without written permission.
- Digital downloads are provided for personal, non-commercial use only unless otherwise agreed in writing.
2. Purchases & Payments
- Prices are listed in [Great British Pounds – GBP] and may change at any time without notice.
- Payments must be made in full before artwork is shipped or digital files are delivered.
- We reserve the right to refuse or cancel an order if fraud is suspected.
3. Shipping & Delivery
- For physical works: Shipping costs, carriers, and delivery times will be disclosed at checkout. We are not responsible for delays caused by carriers or customs.
- For digital works: Files will be delivered electronically to the email address provided at checkout.
4. Returns & Refunds
- Original physical artworks: All sales are final unless the item arrives damaged.
- Prints and merchandise: Returns may be accepted within five [5] working days if unused and in original condition.
- Digital downloads: Non-refundable once delivered.
5. License for Digital Works
Unless otherwise specified in writing:
- Digital works are sold for personal use only.
- You may not resell, modify, print for commercial purposes, or use in advertising.
- Any commercial use requires a separate written license agreement with the Artist.
6. Limitation of Liability
- We are not responsible for any damages, losses, or claims arising from the use or misuse of purchased works.
- Maximum liability to you shall not exceed the purchase price of the artwork.
7. Governing Law
These Terms are governed by the laws of United Kingdom, without regard to conflict of law principles.
8. Changes to Terms
We may update these Terms from time to time. The updated version will be posted on this site with the revised effective date.
